Is FanDuel legally permitted to operate in Nevada?

FanDuel does not operate its daily fantasy sports contests in Nevada, as the Nevada Gaming Control Board (NGCB) has determined that such contests constitute gambling. In October 2015, the NGCB issued a notice requiring all daily fantasy sports operations to cease and desist in Nevada unless they obtained a gaming license. FanDuel, along with other daily fantasy sports companies, withdrew from the Nevada market in response to this ruling. While traditional sports betting is legal and regulated in Nevada, FanDuel's specific model of fantasy sports does not fall under current regulations without the appropriate licensing. Consequently, unless FanDuel secures a Nevada gaming license or there is a change in the state's legal interpretation of daily fantasy sports, it remains unable to operate legally within Nevada.
