Is FanDuel legally permitted to operate in Florida?

As of the last update, FanDuel, a popular daily fantasy sports and sportsbook operator, is not legally permitted to offer online sports betting in Florida. The state had previously entered into a compact with the Seminole Tribe to allow sports betting, which was launched in November 2021. However, this was short-lived as legal challenges emerged, suggesting the agreement violated both state and federal law. A federal judge subsequently ruled that the compact violated the Indian Gaming Regulatory Act because it allowed bets to be placed off tribal lands. As a result of these legalities, FanDuel and other operators cannot legally offer sports betting in Florida until new legislation is enacted or existing compacts are amended while complying with all legal requirements. However, FanDuel's daily fantasy sports contests are available and widely enjoyed by Floridians, as daily fantasy sports exist in a different category of gaming and currently do not fall under the same regulatory restrictions as sports betting.
